Compulsory connection to and use of municipal waste disposal services

Climate and environmental protection are the major issues of our time and, at the same time, the greatest challenges for the future. Environmental protection also includes proper waste disposal. Pollution of the natural environment is a problem that can even pose a health risk to humans in the case of hazardous waste. This makes careful and sustainable waste disposal all the more important. This applies to private households as well as to waste disposal by businesses.

Industries, manufacturing companies, service providers, gastronomy, clinics, and administrations deal with waste on a daily basis. There are numerous laws and regulations regarding waste disposal that must be observed. Violations can result in heavy fines.

Commercial municipal waste often contains a high proportion of recyclable materials that are frequently inadequately sorted. This issue is intended to be optimized through compliance with the Commercial Waste Ordinance. Nevertheless, commercial enterprises are fundamentally required to connect to the municipal waste disposal system. This means they are obliged to use the residual waste containers of the municipal waste service providers and pay the applicable fees for residual waste disposal.

This regulation is already justified in the Circular Economy Act. According to § 17 para. 1 KrWG in connection with § 7 para. GewAbfV, there is a legal presumption that commercial enterprises generate, in addition to recyclable waste, also waste for disposal. This includes, for example, cigarette butts, sweepings, hygiene products, ballpoint pens, highlighters, vacuum cleaner bags, paper tissues, broken porcelain, cleaning rags, etc.

For commercial enterprises located in the City of Frankfurt am Main, § 8 of the Waste Ordinance specifies a minimum container volume for residual waste, taking into account industry-specific key figures.
